Lyndon Station Man Charged With OWI-4th Offense

A Lyndon Station man is facing a fourth operating while intoxicated offense charge. 38-year-old Benjamin Lira faces up to six years in prison or a $10,000 fine, or both.

According to the criminal complaint, on July 7, 2017, a state trooper received a complaint of a vehicle driving erratically on I-90 at milepost 71. He responded and saw the offending vehicle exiting I-90 and stop at a stop sign at CTH HH. The trooper made a traffic stop after observing the vehicle make a wide right turn over the center line and continue in that lane for 100 feet before correcting to the southbound lane. The trooper made contact with the driver, Lira, and could smell an odor of intoxicants emitting from him. Lira stated that he was on the phone and that was the reason for his poor driving. Lira showed signs of intoxication. When asked how much he had to drink that night, Lira said nothing, and said that someone had spilled a beer in the vehicle. Later, Lira stated he had a couple beers. The trooper performed field sobriety tests. Based on the driving behavior, Lira’s appearance of being intoxicated, admission to drinking alcohol, the clues observed during the sobriety tests, and the PBT reading of .142, Lira was arrested for operating while intoxicated. While looking for the keys for the vehicle, a freshly opened and cold bottle of beer was found spilled under the driver’s seat. Lira was transported to the Juneau County Jail without incident.

Lira signed a $5,000 signature bond July 7 and was released. He is scheduled to have an initial appearance August 9 at 9 a.m. at the Juneau County Justice Center.
